The article addresses the management problems in the judiciary and the organizational issues of internal administration of courts and Russian justice system as a whole, as well as external factors influencing organization and work of the courts. The paper analyzes the procedure of forming the institutions and personnel of the judiciary, the recruitment of judges including the occupational requirements for judicial position. In this context, the author also researches professional selection and guarantees of independence and impartiality of judges, considers the procedure of appointing the court chairperson, powers and administrative functions of the head of the bench. The article also contains information on different models of evaluating the quality and efficiency of the courts’ and judges’ work. The author discusses methods to optimize caseload of courts, procedural practices that help to reduce the excessive quantity of cases brought before the courts, as well as ways to eliminate restrictions against judicial protection. The paper also surveys the Russian experience in monitoring functioning of the judiciary at all its levels and, too, shows implementation of recommendations of international judicial bodies in Russia and the degree of Russian courts’ conformity with standards and national practices of other countries. The article raises the question of extra-procedural ways and procedural tools in reducing judicial reviews and appeals for judicial protection. The author considers as unacceptable any attempts – allegedly in order to ensure legal certainty – to reduce fair trial standards, to impede human rights protection functions of the judicial system and to refrain from correcting courts’ mistakes.
