Each decision of the Constitutional Court of the Russian Federation attracts the close attention of the legal community, since it affects a huge stratum of social relations and affects the development of law in general. Therefore, it is not surprising that the court ruling in a case verifying the constitutionality of the Agreement on the establishment of the border between the Republic of Ingushetia and the Chechen Republic has piqued interest. This decision created a number of issues requiring further discussion, the formulation of which is the purpose of this work. Many of the legal positions expressed by the court seem at least debatable. The disagreement is caused by additional restrictions imposed by the court on holding referendums, citing that this institution substitutes the legislature, as well as a significant diminution of the role of local self-government and declaring the priority of administrative activities of regional government bodies over the constitutional right of citizens to local self-government. Also of interest are the conclusions of the court about its own competence, in particular about the possibility of a de facto revision by the Constitutional Court of Russia of decisions of regional constitutional (statutory) courts, as well as about subjects of filing requests to the constitutional court and about rules for filing requests for verifying the constitutionality of regulations. Some positions of the court concerning the procedure of legislative activity of regional legislative bodies are controversial, such as on the admissibility of passing laws by secret ballot and on the constitutionality of laws adopted with gross violation of procedural requirements. Particular attention is drawn to the fact that the court in this one ruling repeatedly refutes its own previously formulated positions on these aspects and demonstrates the opposite approach or significantly tightens the regulation on the implementation of constitutional rights. All these reasons lead to the conclusion on the need to develop theoretical approaches to the new positions of the Constitutional Court, and also once again raises the question of improving the legislative regulation of the powers of the Constitutional Court.
