In democratic states the issue of personal data protection is of constitutional importance, while constitutional grounds and limits of such protection are different in national legal systems. This paper focuses on a comparative analysis of approaches to the constitutional protection of personal data in Russia and Germany and a search for an answer to the question, which constitutional provisions provide their protection and to what extent. Whereas a strong system of constitutional protection of personal data already formed in Germany, in Russia the possible approaches to the protection of personal data at the level of constitutional law are still in initial phase. The German model of the constitutional protection of personal data is disclosed through four fundamental rights: right to informational self-determination, right to confidentiality and integrity of information technology systems, right to secrecy of telecommunication, right to inviolability of the home. The Russian model of the constitutional protection of personal data is shaped by constitutional rights to inviolability of private life, to secrecy of correspondence, of telephone conversations, postal, telegraph and other messages and to inviolability of the home. In addition, the role of international and supranational law in the development of national models is disclosed with particular analysis of the case-law of the European Court of Human Rights in cases relating to personal data protection. As a result of this research the author comes inter alia to the conclusion of the necessity to extend the scope of the term «private life» and consequently of the right to inviolability of private life in the Russian constitutional law.
