Right to information in the light of the subjective rights theory

Abstract

The article addresses the problem of the subjective public rights – a concept developed in the 19th century by German lawyers. In Russia this topic has caused an increased interest due to the development of administrative justice and legal questions aroused after adoption of the Code of administrative judicial procedure. The author notes the dominating civil-law bias in the Russian legal doctrine in the field of the subjective rights. It is deeply rooted in a thoroughly elaborated of subjective rights problem in civil law doctrine. The author considers recent processes of subjectivisation of basic rights in public law sphere as well as seeks theoretical grounds for the new understanding of subjective public rights in the information society, especially affects constitutional freedom of information. The right to information by the Internet acquires new forms, meets new challenges, and, respectively, needs new guarantees. The essential ground for implementation of the citizens’ rights to information in the public administration sphere should be transparency of public administration which is to be ensured by the State. In her analysis of the state policy of access to the Internet, the author maintains that the actual answer to problem should be recognizing access to the Internet as a new fundamental human right at the international level. The development of legal processes in the world clearly demonstrates the movement to an official recognizing of the right to the Internet availability. If the right to the Internet access would become a fundamental right, the State duty to guarantee the subjective public rights would become more accurately outlined.
